UK Government launches new ‘Social Care Compliance Scheme’

The 'Social Care Compliance Scheme' (SCCS) is an opt-in scheme for providers to work with HMRC to identify any potential underpayment of National Minimum Wage.

Providers who choose to opt-in to the scheme will be given 12 months to identify any back-pay shortfall, followed by a further 3 months to make the payment. Those who opt-in and comply in the timeframe will not be subject to the additional fines for breaching National Minimum Wage regulations. Providers who do not opt-in will be subject to HMRC's usual enforcement procedures.

The Government's announcement can be found at:

We would advise any providers who are considering using the opt-in scheme to obtain legal advice.
